Terms & Conditions of Occupancy
NOTICE: All properties represented by Finger Lakes Vacations, Inc. (FLV) are individually owned and operated and furnished to the needs of the Owner. Owner's personal property must be respected. FLV represents the Owner(s) of the property(s) in a client/agency relationship. The terms Guest(s) & Guest(s) are used interchangeably and are defined as the principal party(s) renting a vacation property & those accompanying the principal party.
Please Review Terms and conditions of occupancy as these terms apply to all properties. Terms and Conditions are not subject to any modification.
ALL RESERVATION CONFIRMATIONS REPRESENT THE FOLLOWING CHARGES:
• Rental Rate (Owner approved)
• NON-Refundable Guest Reservation Fee 10% of the Rental Rate.
• Departure Cleaning Fee (Owner approved)
• Additional charges as requested for Linen/Highchair/Crib rentals. (Owner approved)
• Security Deposit is OWNER DETERMINED.
• Pet Fee (if applicable) per pet/stay. (Owner approved)
SECURITY DEPOSIT: (Owner approved)
Owners will dictate security deposits amounts as well as terms and conditions as applicable.
RENTAL PAYMENT/BALANCE DUE: (Owner approved)
Owners will dictate rental payments and balance due amounts as well as terms and conditions as applicable.
LEASE/DEPOSIT REQUIREMENTS (Owner approved)
Owners will dictate lease/deposit requirements as well as terms and conditions as applicable.
CHECK/IN and CHECK/OUT INSTRUCTIONS (Owner approved)
Owners will dictate check/in and check/out instructions as well as terms and conditions as applicable.
KEY RELEASE and KEY RETURN (Owner approved)
Owners will dictate rental key release and rental key return instructions as well as terms and conditions as applicable.
HOUSEKEEPING / CLEANING FEE:
All properties require departure-cleaning services. Guests are responsible for leaving the property in good order upon their departure for the next guests of arrival. Departing Guests “must leave home the way they found home”. Guest shall leave all doors and windows locked and make sure the heat (winter excluded) and lights are turned off upon checkout. With limited time available between guests, guest is required to complete the following:
• Beds must be stripped with comforters, pillows, shams, blankets and the like folded on each bed.
• Towels (courtesy if provided) must be washed and dried and placed back in original locations (bath).
• Refrigerator must be cleaned out of all open food containers and wiped down inside and outside.
• ALL trash must be in sealed plastic bags, removed and placed in proper receptacle(s) as provided.
• Kitchen counters and Bathroom counters must be wiped down and removed of personal item(s).
• Carpets and floors are to be broom swept and vacuumed cleaned as necessary of excessive debris.
• Rental key must be returned as instructed by owner for next arriving guest.
• Failure to complete the above will result in forfeit of the security deposit.
SECURITY/DAMAGE DEPOSIT (REFUNDABLE):
The Security/Damage deposit is to insure compliance with the Terms of Occupancy. The Security/Damage deposit is held until determination of condition and content of the rental property upon check-out. Charges are assessed to cover damage, cleaning and unnecessary service calls. Please report any problems or damages observed in the rental property upon check-in. Unreported problems and /or damages are assumed to have occurred during occupancy and guest shall be held responsible for those damages. Security deposits are the sole responsibility of the OWNER inspection for return/refund/forfeit.
NON-REFUNDABLE GUEST RESERVATION PROCESSING FEE:
All reservations require a non-refundable Guest Booking Fee of 10% of the rental rate.
All cancellations must be in writing directed to OWNER. Owners will dictate security deposits regarding cancellation fees and policy amounts as well as terms and conditions as applicable.
Any change or transfer of a confirmed reservation within the same property date is subject to a $75.00 Change/Transfer fee & property Owner approval. Changes from one property to another are subject to OWNER cancellation terms & conditions as applicable.
Most Properties do not allow pets due to Owner preference or allergy concerns. Guests (including visitors and day guests) who bring pets to non-pet properties will be subject to pet fees, additional cleaning fees and possible removal from the property without refund. Owners will dictate pet approval, application, additional pet deposit and instructions as well as terms and conditions as applicable.
METHOD OF PAYMENT:
All rates quoted by the Individual Owners are amounts payable by cash, check, or money order made payable to Owner of Property
CHECK-IN TIME (Owner approved):
Check-ins take place at the Individual Vacation Property Address is Owner approved Sorry, early Check-Ins ARE NOT available. Please schedule arrivals accordingly. If a guest is to arrive after approved Owner Check-In time and is requested “Late Arrival Guarantee”, Guest must notify OWNER or call the OWNER immediately regarding special instructions for picking up your keys.
CHECK-OUT TIME (Owner approved):
Check-Out and vacating the property on the day of departure is Owner approved. Guest will be charged one additional day rental if property is not vacated by Check-Out time. All property keys must be returned to OWNER. There is a $25.00 charge to principal party for lost, missing or keys not returned to OWNER by designated Check-Out time on day of departure. Fees for non-returned keys will be charged to guest directly by Owner.
Guests may request a “roll-over” reservation for the following year in any vacation rental home that we advertise. Pending final OWNER Approval. Guests returning to same vacation rental home same time and date following year do have first priority to reserve their vacation rental home they are currently staying in during the same rental week for the following year as long as you fill out the online booking reservation link immediately after your date of departure pending final OWNER Approvals. Remember, if you do not fill out your on-line BOOKIT Reservation Request link by immediately after your date of departure, the vacation rental property dates will be opened to the next wait-listed guest reservation. We operate strictly first-come first-serve basis. No exceptions!
Note: Owners always have first bid on their property and their requested vacation time takes priority. If an Owner is unable to open your week for next season and make available, we will assist you in finding another rental vacation home accommodations. NOTE: Rental rates are subject to change and rental vacation home amenities may change from year to year including furnishings and the like.
Guests are responsible to place SEALED, BAGGED trash in containers for weekly trash removal. Trash must be sealed and bagged in plastic trash bags and left in designated area in supplied containers. Trash not sealed and placed in plastic bags or in designated areas will result in charges to guests. Individual property Owners arrange for trash removal services. As a courtesy, please put out prior guest's trash and the next guest will do the same for you. If these rules are not abided by or there is excessive trash (over 8 Large Bags) to be removed the guest will forfeit the entire SECURITY DEPOSIT.
The rental property is to be left generally clean with bagged trash removed and stored in trash receptacles provided by the Owner and taken to designated pick-up areas. All kitchen equipment and utensils are to be cleaned and stored. All floors are to be broom clean. Any furniture or bedding should be in a neat and tidy order. Rental items should be left as required by OWNER.
Guest acknowledges that the rental property may not be sublet. Subleasing shall immediately void any rental agreement with no refund due to guest.
Vacation properties are limited to the maximum occupancy as stated in the confirmation provided with these terms of occupancy by Owner. Overnight guests (8:00 p.m. - 8:00 a.m.) are limited to the maximum occupancy limits by Owner and includes all adults and children under the age of two (2) years. If a guest plans to have DAY GUESTS, you must contact the OWNER prior to arrival. Groups who misrepresent themselves will be grounds for removal from property with no refund.
HOUSE PARTIES/LARGE GATHERINGS:
House parties and large gatherings exceeding maximum occupancy are strictly prohibited and will result in guest's immediate removal. *Please request information for special exceptions for weddings, parties or large events with Owner prior to Guest check-in. Sheriff calls are immediate removal.
For guest's enjoyment and the enjoyment of others, please respect quiet times between 9PM and 9AM.
Parking is limited in many of our lakefront and non-lakefront rental vacation homes. The number of vehicles each property will accommodate is stated on the Owner’s confirmation. Excess vehicles at the property are subject to removal at Guest’s expense. Owners will dictate parking areas and instructions as well as terms and conditions as applicable
Accommodations range from luxury resort lakefront homes to very basic cottages. All properties are privately owned, individually furnished and owner placed for equipped kitchens as well as for housekeeping services with basic items such as pillows, blankets, cookware, flatware and dishes. Other small appliances, beach chairs, grills, TV, radio, fans, etc., may or may not be provided. The OWNER is unable to provide additional furnishings or appliances.
Owners will dictate campers/motor homes/tents and the like instructions as well as terms and conditions as applicable.
Most rental properties are equipped with TV's. When TV's are provided, they are listed on the property amenity sheet. Reception in the Lakes can be very limited and available only with cable or satellite service. Cable service varies from (basic 10 +/- channels) to (expanded 40 +/- channels) check with Owner regarding cable channel service in your specific rental vacation home.
TELEPHONE SERVICES/COMPUTER ONLINE USE:
Many properties are not equipped with telephones for local calls and are not setup for computer usage. Guests tend to bring their own cell phones and laptops for usage outside of the rental vacation property.
Many properties are not equipped with internet access. Unfortunately, some rural areas in NH are not equipped for internet access and are unavailable. Properties with internet access are indicated on the property amenity listing.
GAS GRILLS AND CHARCOAL BBQ'S:
Properties that include gas or charcoal grills provide gas tanks and cooking surfaces only. GAS AND CHARCOAL IS THE GUESTS RESPONSIBILITY. OWNER can provide a list of local filling stations. Outdoor cooking is allowed, but only in U/L approved grills. ALL cooking surfaces must be left clean by guest upon departure to avoid extra cleaning charges. Owner will provide gas grilling and charcoal instructions.
Campfires are ONLY permitted in approved fire pits provided by property Owners. . Campfires are permitted in DESIGNATED AREAS! Owners will provide outside campfire pit instructions.
FIREWORKS: OWNER DETERMINES if Fireworks are permitted at rental homes.
MECHANICAL & APPLIANCE FAILURE:
Owner will use its best efforts to have mechanical (water, septic, electrical and plumbing) and appliance failures corrected as soon as possible, but cannot control the scheduling of outside service contractors. NO REFUNDS will be made for appliance(s) or mechanical failures or breakdowns. Owner shall have the right to arrange, inspect and make repairs during rental period. Guest will be charged for unnecessary maintenance and service calls or repairs caused by abuse beyond normal wear and tear. NO refunds will be made for the malfunction of appliances or other equipment.
BEACH SIZE/LAKE LEVELS & INCLEMENT WEATHER:
From Spring to Fall, major lake levels vary up to two (2) feet. State controlled lake levels may affect beach size, launching area and water depths. SORRY, NO REFUNDS WILL BE MADE FOR INCLEMENT WEATHER, CHANGES IN BEACH SIZES, LAUNCHING AREAS OR WATER DEPTHS.
As our area continues to grow, we cannot predict when or where new construction will begin. FLV has no control in these situations, and cannot move or offer refunds on confirmed reservations if construction occurs near the property being occupied for rental purposes.
Each rental vacation property is privately owned and operated and reflects the Owner's personal taste. Each property is represented by FLV as realistically as possible online with regard to space, physical size and comparison.
Some individual communities and associations have rules and regulations that become part of the guests Terms and Conditions of Occupancy. Community rules that apply are provided to Guest at check-in or may be requested prior to occupancy from Owner if applicable.
If the vacation rental property becomes unavailable or uninhabitable, FLV reserves the right to move a guest to a comparable location accommodating the same number of persons and within the same price range. FLV cannot guarantee availability or comparability of other properties. Owner and FLV are not liable for any acts of nature or major mechanical failure that would prohibit or limit the use of a property.
ERRORS & OMISSIONS:
FLV has taken great effort to ensure the information in our website and all of our printed material is accurate. We cannot be held responsible for errors, omissions, or change in prices. All rental properties are privately owned and their furnishings vary depending upon the Owners' taste. Finger Lakes Vacations, Inc. cannot guarantee the presence of particular listed furnishings because they may change from time to time depending on the Owner's taste.
Guest(s) hereby agree(s) to hold and save harmless Preferred Vacations Rentals, Inc., their employees, and the property Owner from damages or injuries to personal property by reason of any cause whatsoever, either in or about the occupied property or elsewhere.
Finger Lakes Vacations, Inc. represents the property Owner(s). FLV will make every effort to assist guest(s). FLV is a vacation home rental company and the management of the property is the sole responsibility of the Owner(s).
The guest whose name appears on the confirmation is responsible for all terms and conditions set forth in this document for them, their guests or others they may have visiting or staying at the vacation rental property during their term of occupancy.
VIOLATION OF TERMS OR CONDITIONS OF OCCUPANCY:
When Guest(s) violate(s) any of the terms of occupancy, property rules, community rules or regulations, the guest(s) may be asked to vacate the property by FLV and NO refund will be due to guest(s).
GUEST AGREES TO ABIDE BY THESE TERMS OF OCCUPANCY UPON TENDER OF ANY PAYMENT. FLV AGREES TO MAKE PROPERTY AVAILABLE SUBJECT TO THIS DOCUMENT AND RENTAL CONFIRMATION SUPPLIED TO GUEST.
